Since his return to the White House earlier this week, President Donald Trump has issued over 200 executive orders, marking a historic surge in activity aimed at reshaping federal policies across a wide array of issues.

Among these, one of the most polarizing and far-reaching is an order titled “Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government.”

This directive, which profoundly affects non-binary individuals, notably those who benefited from the option of selecting an “X” gender marker on passports—a policy implemented during the Biden administration—has sparked an intense national debate about identity, inclusion, and the government’s role in personal recognition.

The Executive Order’s Core Provisions

President Trump’s executive order establishes a rigid binary framework for gender identification within federal documentation, recognizing only “male” and “female” based on biological sex at birth. This policy overturns the previous ability to select an “X” gender marker, which accommodated non-binary, genderqueer, and other gender-diverse individuals.

Key components of the order include:

  • Suspension of Non-Binary Gender Markers: Effective immediately, all applications requesting an “X” gender marker on passports are suspended indefinitely. While passports already issued with this marker remain valid, renewals or updates will face significant scrutiny, with potential denials under the new rules.
  • Policy Enforcement: All federal agencies are required to follow the binary gender classification. Secretary of State Marco Rubio has directed that federal documentation systems prioritize “sex, not gender,” emphasizing biological determinism as the foundation for official records.
  • Reversal of Prior Initiatives: This order directly counters the Biden administration’s inclusivity efforts, such as the landmark issuance of the first U.S. passport with an “X” gender marker in October 2021.
